![]() Beatrice Withers This is my wife Beatrice. We both were in our 70's when this fight began. We have lost our home and my wife was rendered permanently disabled. Social Security is our sole source of income. State Farm Insurance has dragged their feet for years, refusing to honor our claim. Our claim is just and honorable. Our well was poisoned by fecal contamination by a neighbor also insured by State Farm Insurance.
In 1989 my wife became very ill and was transported to a Colorado Springs hospital where she remained for 30 days. She was diagnosed with kidney failure, liver and heart problems. |
She was disabled because of this
poisoning until her death in 1996. Physicians concluded that fecal coliform had entered
our water source from animal waste which was flushed from our neighbors property and
collected directly above our wellhead. Immediately after learning this we filed a claim against our neighbors State Farm Insurance Homeowners policy. Our water was tested by three independent water testing labs. Each test revealed the presence of fecal coliform in our drinking water. We were instructed by my wifes attending medical team to evacuate our home and property. For seven months we lived in a small motel room while our health problems continued. My wife was on oxygen day and night for 1 ½ years.
State Farm Insurance has stalled and made repeated excuses for not honoring our valid claim for damages. I feel that we, as senior citizens, are being discriminated against by State Farm and that it is their intention to delay this claim until we die. In this way they will not be required to pay on this claim. At our ages, we should not have to spend our days picketing a State Farm Insurance claims office in an attempt to collect on a just and valid claim. Addendum: State Farm did offer us a small check for living expenses if we agreed to sign a waiver on the claim for damages. As a result of the medical condition arising from the contamination, my wife died on 10/15/96. |
